What Legally Qualifies as a Hostile Work Environment

Not every unpleasant workplace rises to the legal standard. For harassment to constitute a hostile work environment, federal and Tennessee courts apply a “severe or pervasive” standard: a reasonable person would have to find that the conduct altered the conditions of employment and created an abusive working environment. Minor or isolated incidents generally don’t meet that threshold. Pattern, frequency, and severity all factor into the analysis.

Federal law, including Title VII of the Civil Rights Act, the Age Discrimination in Employment Act (ADEA), and the Americans with Disabilities Act (ADA), prohibits harassment based on race, color, religion, sex, pregnancy, age, national origin, disability, and genetic information. The Tennessee Human Rights Act extends similar protections under state law and covers employers with eight or more employees. The harasser can be a supervisor, a co-worker, or even a customer or vendor. You don’t have to be the direct target of the conduct to have a claim. Employers can be held liable when they knew or should have known about the harassment and failed to act.

The EEOC & CRED Filing Process for Memphis Workers

Before filing a federal lawsuit based on workplace harassment, employees are generally required to file a charge with the Equal Employment Opportunity Commission (EEOC), the federal agency that enforces Title VII and related anti-discrimination laws. The EEOC maintains an office in Memphis. Employees should also report harassment internally to HR or a supervisor before or during this process, as employers must be given a reasonable opportunity to address the problem.

At the state level, there has been a significant recent change. As of July 1, 2025, the Tennessee Human Rights Commission (THRC) was dissolved. State-level employment discrimination complaints are now filed with the Civil Rights Enforcement Division (CRED) within the Tennessee Attorney General’s Office. The confirmed filing deadline with CRED is 180 days from the date of the discriminatory act. Whether CRED will obtain Fair Employment Practices Agency (FEPA) status, which previously extended the federal EEOC filing window to 300 days for Tennessee workers, remains legally unresolved. Once the EEOC process concludes, you may receive a Right to Sue letter authorizing a federal lawsuit, which must typically be filed within 90 days of receipt.
