Whistleblower Lawyer in Memphis
More Than 35 Years Advocating for Employees Who Speak Up
Reporting unlawful conduct or refusing to participate in it can put an employee’s career at risk. At Donati Law, PLLC, we represent employees, not employers, in employment law matters involving whistleblower retaliation, wrongful discharge, and related workplace actions. We also guide employees through the whistleblowing process for OSHA safety complaints.
Tennessee generally follows the employment-at-will rule, under which either party can end the working relationship. Statutory and common-law protections create important exceptions. Whether a report is legally protected depends on what was reported, how the employee raised the concern, and why the employer took action. Our attorneys bring more than 150 years of combined experience to that analysis.

How Tennessee Protects Employees from Whistleblower Retaliation
The Tennessee Public Protection Act protects employees who are discharged solely because they refused to participate in or remain silent about illegal activities. Under the statute, illegal activities include violations of state or federal civil and criminal laws, as well as regulations intended to protect public health, safety, or welfare.
Tennessee law also separately protects public and private employees who speak out about occupational safety or health violations. A report involving safety, discrimination, or wage practices must be evaluated under the law governing the conduct and the employer’s response. Making a complaint doesn’t automatically establish a retaliation claim.
Actions That May Constitute Retaliation
Retaliation isn’t limited to immediate termination. It may involve a series of actions taken after an employee reports wrongdoing or refuses an unlawful instruction.
Potential adverse employment actions include:
- Termination from employment.
- Pressure to resign or a forced resignation.
- Demotion to a lower position.
- Reduction in scheduled hours.
- Discipline following the protected activity.
- Other materially adverse changes to employment.
Government Fraud & Qui Tam Actions
A private employment retaliation claim is distinct from a qui tam action involving alleged fraud against the government. Under the federal False Claims Act, a private person who brings a qui tam case on the government’s behalf is called a relator. These actions involve procedures and legal requirements separate from claims based on an employer’s retaliation.
Anyone considering reporting government spending fraud should obtain advice about the applicable law and filing process. The analysis may involve both the underlying conduct and any employment action taken in response, but the two legal paths aren’t interchangeable.
